LABOR LAW

 

The labor code passed in 1997 provides a framework for the relationship between employee and employer. It outlines the responsibility of employer, scope of apprenticeship, general working conditions and framework for settling the labor disputes, strikes and labor courts.

 

* Under the labor code, employees should be entitled to:

 

  -     Minimum Wage of US$ 39.00

               

  -     Overtime pay ranges from 1.5 to 2 times the basic pay rate

               

  -     Annual leave offer after one year of service is 1.5 times number of months of service days     and increase by one day per three years of services.

 

 -     Sick leave is not specified

               

 -     Severance pay of 7 days minimum depending on length of service

               

 -     Maternity leaves of 90 days with half pay after 1 years of service

 

* Foreign Labor:

 

The Labor Code stipulates that no foreigner can work unless he/she possesses a work permit and visa entry and that the employer must ensure the foreigner has legally entered Cambodia, is holding a valid passport, and is sufficiently qualified to hold his/her position and must be in good health.

 

All foreigners working in Cambodia are registered with the Ministry of Labor and apply for a certificate of employment and labor book. As a guideline, employment of foreigners is guided by the ratio of one foreigner to ten Cambodian staff.
